Welcome to Probed ("we," "us," or "our"), operated at probed.space. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

1. Description of Service

Probed is an information aggregation and analysis platform. The Service collects, organizes, and displays publicly available information from third-party sources across the internet, including but not limited to news outlets, social media platforms, public databases, and government filings. We use automated processing systems, including artificial intelligence and machine learning technologies, to classify, score, summarize, and organize this information for our users.

The Service may include features such as content feeds, signal scoring, content clustering, entity tracking, interactive maps, daily briefings, push notifications, and other tools for monitoring publicly available information.

2. Acceptance of Terms

By creating an account, browsing the site, subscribing to communications, or otherwise accessing any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We reserve the right to modify these Terms at any time. Changes take effect upon posting to this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

3. Eligibility

You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. 6. Automated and AI-Generated Content

Portions of the Service — including but not limited to content classifications, relevance scores, signal ratings, summaries, trend analyses, briefings, and organizational labels — are generated by automated systems using artificial intelligence and machine learning technologies. This content is produced algorithmically and does not represent the editorial opinions, judgments, or endorsements of Probed or its operators.

AI-generated content may contain errors, inaccuracies, biases, omissions, or outdated information. Scores, ratings, and classifications assigned by our automated systems are computational outputs based on algorithmic models and should not be interpreted as definitive assessments of truth, importance, credibility, or reliability.

The Service does not constitute professional, journalistic, scientific, legal, investigative, intelligence, or any other form of professional advice. You should independently verify any information obtained through the Service before relying on it for any purpose.

7. No Endorsement of Claims

The Service aggregates content that may contain unverified claims, allegations, theories, speculation, eyewitness accounts, personal opinions, and contested assertions. All rights are reserved.

You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service or its proprietary systems without our prior written consent.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Scrape, crawl, harvest, or use automated means to access or collect data from the Service, except as expressly permitted by us in writing.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or data models of the Service.
  • Circumvent, disable, or interfere with any security, access control, or rate-limiting features of the Service.
  • Reproduce, redistribute, or commercially exploit Service content or features without our express written permission.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Introduce viruses, malware, or any code designed to disrupt, damage, or interfere with the Service.
  • Use the Service to harass, abuse, threaten, or intimidate any person.
  • Attempt to gain unauthorized access to any part of the Service, its servers, or any connected databases or systems.

We reserve the right to investigate and take appropriate action against anyone who violates this section, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

10. Copyright and DMCA Takedown

We respect the intellectual property rights of others. If you believe that content displayed on the Service infringes your copyright, you may submit a takedown request under the Digital Millennium Copyright Act (DMCA) by providing the following information in writing to our designated agent:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material on the Service that is claimed to be infringing, with sufficient detail to allow us to locate it (e.g., a URL).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material and make reasonable efforts to notify the party that posted it. We may also terminate the accounts of repeat infringers.

Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification containing: (a) your physical or electronic signature; (b) identification of the removed material and its prior location; (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake; and (d) your name, address, telephone number, and consent to jurisdiction. We will forward the counter-notification to the original complainant, and if they do not file a court action within 10 business days, we may restore the material.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR AVAILABILITY.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, completeness, or timeliness of any content — whether sourced from third parties or generated by our automated systems. We do not guarantee that any scores, ratings, classifications, or analyses produced by the Service are correct, complete, or suitable for any particular purpose.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROBED, ITS OPERATORS, AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Probed, its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit through the Service.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, limitation of liability, and indemnification.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Wisconsin, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and Probed regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.
