The UAP NDA waiver is the set of 2026 measures that release people holding government UAP information from their nondisclosure obligations when they speak to designated officials. Its formal instrument is a legal waiver the Department of War announced on September 14, 2026. It covers current and former service members, civilian employees and contractors with UAP-related national defense information, and for disclosures made to representatives of PURSUE, the Presidential Unsealing and Reporting System for UAP Encounters, it supersedes the civil and administrative enforcement provisions of nondisclosure agreements and Special Access Program indoctrination agreements.
The waiver implements a presidential directive first reported by Fox News on July 21, 2026: citing senior administration officials, it said President Trump had told agencies to waive prior agreements for former employees and contractors who met designated officials at AARO or PURSUE, and one official said it was not a "declassification directive." On July 31, Principal Deputy Director of National Intelligence Aaron Lukas signed memorandum ES 2026-00818, preliminary guidance under which the department and the intelligence community would waive prior "agreements, oaths, or commitments" for current and former staff speaking with AARO or PURSUE. It gave intelligence agencies 30 days to name a PURSUE designee and tell their workforce such agreements "are no longer in force." Representative Eric Burlison released the memo on August 1, and Deputy Pentagon Press Secretary Joel Valdez posted the department's waiver in September.
The waiver declassifies nothing. The Debrief reported that it gives no blanket authority to reveal classified information publicly, and that submissions go through security review and possible declassification before any release. DefenseScoop reported that Pentagon spokespeople did not identify the PURSUE representatives or answer its questions. The Disclosure Foundation's Jordan Flowers called the step "a meaningful step toward establishing the facts." Dylan Borland, a former Air Force geospatial intelligence specialist who testified to Congress, welcomed relief on the Defense Department side but said, "It doesn't change the Intelligence Community side." Jeremy Corbell and George Knapp listed more than 20 questions they said the government would not answer, including who runs the program, what protections witnesses receive and whether Congress gets the information.
The measures are the executive branch's most direct step toward removing secrecy agreements as a barrier to UAP testimony, an obstacle lawmakers had raised since 2023, and they add PURSUE to AARO as a channel Flowers describes as legally protected. Their scope still stops at officials inside the executive branch, and the public value of what witnesses report depends on later declassification review.
